Terms of Service

1. Acceptance of these terms

By visiting TraceTray, creating an account, installing the tracker, submitting website interaction data, or using the dashboard, you agree to these terms and the Privacy Policy. If you do not agree, do not use TraceTray.

2. What TraceTray is

TraceTray is a behavioural web analytics service. It records selected cursor, touch, click, scroll, pause, page, and session events, then calculates patterns intended to help website owners understand how visitors browse their pages.

TraceTray is currently offered as a beta product. Features, limits, analysis methods, stored fields, and availability may change as the service develops.

3. Accounts and sign-in

Dashboard access requires a signed-in account. Authentication and account sessions are handled through Clerk, with Google or other sign-in methods available where configured.

You are responsible for keeping your account secure and for activity performed through your account. Do not share access to your account or site key with anyone who should not be able to submit or view your analytics data.

4. Beta access and future paid plans

TraceTray is currently free during the beta. Beta access does not guarantee permanent free access, unlimited storage, continued availability, or access to every future feature.

TraceTray may introduce paid plans, usage limits, trial periods, or feature restrictions later. Pricing and plan details will be shown before paid access is activated. Stripe may be used for checkout, subscriptions, invoices, cancellations, and billing portal access. TraceTray does not store full card details.

5. Permission to track a website

You may install TraceTray only on websites and pages that you own, operate, or are authorized to manage. You must not use another person's site key or add the tracker to a website without permission.

You are responsible for deciding whether and how TraceTray may be used under the privacy, cookie, employment, consumer-protection, and data-protection laws that apply to your website and visitors.

6. Visitor notice and consent

You are responsible for providing any privacy notice, cookie banner, consent request, opt-out, or other disclosure required before collecting visitor interaction data. TraceTray does not determine which laws apply to your website and does not obtain visitor consent on your behalf.

You should clearly explain that behavioural interaction data is being collected and link visitors to an appropriate privacy policy.

7. Sensitive data and prohibited tracking

Do not intentionally use TraceTray to collect passwords, typed form contents, payment details, health information, government identifiers, precise financial information, private messages, or other highly sensitive personal information.

Do not install TraceTray on pages where the normal interaction data would reveal sensitive personal information unless you have a lawful basis, appropriate safeguards, and any consent required by law.

8. Acceptable use

Do not use TraceTray to:

• break the law or violate another person's privacy or intellectual-property rights;
• track websites, accounts, or visitors without the permission or legal basis required to do so;
• collect data for stalking, harassment, discrimination, surveillance abuse, or harmful profiling;
• attack, scrape, reverse engineer, overload, bypass limits, or disrupt TraceTray;
• access accounts, site keys, sessions, reports, or systems you are not authorized to access;
• submit malware, misleading data, spam, or unlawful content;
• use automated summaries as the sole basis for high-impact decisions about a person.

9. Analysis results and automated summaries

TraceTray uses statistical and machine-learning methods to group similar browsing sessions and identify patterns. Results depend on the amount, quality, and context of the collected data. They may be incomplete, unstable, or misleading, especially with small datasets.

Some summaries and suggestions may be generated using Anthropic's API. These outputs may contain errors and should be reviewed alongside the underlying measurements and your own knowledge of the website.

10. Bug reports and feedback

TraceTray includes a bug-report tool. Reports may include the message you submit, the current dashboard section, page URL, browser information, submission time, and account identifiers.

You grant TraceTray permission to use submitted feedback to investigate issues and improve the service. Do not include passwords, payment information, visitor data, or other sensitive information in a bug report.

11. Third-party services

TraceTray depends on third-party services, including Clerk and connected identity providers for authentication, Anthropic for automated summaries, MongoDB for storage, hosting infrastructure for the website and API, and potentially Stripe for future billing.

Third-party services have their own terms and privacy policies. TraceTray is not responsible for their independent content, availability, outages, policies, security practices, or decisions.

12. Ownership

TraceTray and its original software, branding, interface, and documentation are owned by TraceTray or its creator. These terms do not transfer ownership of TraceTray to you.

You retain responsibility for your website and the data you lawfully submit through it. You give TraceTray permission to host, process, analyze, and display submitted data as needed to provide the service.

13. Suspension and termination

TraceTray may restrict, suspend, or terminate access when reasonably necessary to protect the service, investigate abuse, respond to legal obligations, enforce these terms, or address security or operational risks.

You may stop using TraceTray at any time by removing the tracker. Account or data deletion requests can be sent to hello@tracetray.com.

14. Availability and changes

TraceTray may change, add, remove, pause, or discontinue features at any time. The service may be unavailable because of maintenance, bugs, hosting issues, provider outages, abuse prevention, or other reasons.

TraceTray does not guarantee uninterrupted access, permanent data storage, perfect analysis, or error-free operation.

15. Disclaimer

TraceTray is provided as-is and as available. To the fullest extent allowed by law, no warranties are made about accuracy, reliability, availability, fitness for a particular purpose, or non-infringement.

TraceTray is an analytics aid. It is not legal advice, a compliance service, or a replacement for professional privacy or data-protection guidance.

16. Limitation of liability

To the fullest extent allowed by law, TraceTray is not responsible for indirect, incidental, special, consequential, or punitive losses, lost profits, lost data, business interruption, visitor claims, compliance failures, or issues caused by third-party services.

Your main remedy if you are dissatisfied with TraceTray is to stop using the service and remove the tracker. Some laws may provide rights that cannot be limited by these terms.

17. Changes to these terms

TraceTray may update these terms as the product, providers, or business model changes. The latest version will be posted on this page. Continued use after changes are posted means you accept the updated terms.
